One of the individuals implicated in the Fishrot corruption and fraud scandal has lodged an application seeking to compel the prosecution to provide further details about the allegations contained in the indictment.

Ricardo Gustavo’s lawyer, Ileni Gebhardt, indicated yesterday in the Windhoek High Court that they had lodged the motions last Friday.

An application for particulars is understood as one made by a party in a court case to obtain further details about the opposing party’s allegations.

In this case, Gustavo and his company, Namgomar Pesca Namibia, is seeking for further details from the State, specifically details of the allegations against them.

In his application, he wants the State to provide the requested particulars within 21 days of the court order.

Alternatively, according to the notice, if the State maintains that the information is already contained in existing documents, Gustavo wants the State to identify the relevant documents and page numbers and confirm that these are the particulars on which it relies against him and his company.

Gustavo wants specific details about how he allegedly committed the offences alleged against him and his company.

These details include the offences said to constitute racketeering, the property allegedly involved in money laundering, the date on which the conspiracy on the count of conspiracy to commit corruption formed and the gratification allegedly paid to public officials.

He is also seeking clarity on representations on which the fraud charges he faces are based and on the alleged tax fraud and conspiracy charges, which includes the tax years and amounts of income allegedly concealed, as well as the specific acts attributed to each of them.

Sacky Shanghala and James Hatuikulipi yesterday also indicated their intention to bring along a similar application.

Shanghala also informed the court about the various applications that are still pending in the matter, including the petition to the Supreme Court for the recusal of acting judge Marilize du Plessis and the application to stay proceedings in the criminal case, among others.

Judge Eileen Rakow postponed the matter to 11 November 2026 for the hearing of the application for further particulars.
